EADs Auto-Extended Through: January 22, 2012 (this is for those who already have a TPS-related EAD valid through July 22, 2011)

TPS Re-designation Date: July 23, 2011

The forms to register and re-register for TPS are:

  • Form I-821, Application for Temporary Protected Status
  • Form I-765, Application for Employment Authorization

Individuals filing for the first time
The re-designation of Haiti allows additional Haitians (and persons without nationality who last habitually resided in Haiti) who have continuously resided in the United States since Jan. 12, 2011 to obtain TPS, provided they meet all other Haiti TPS eligibility criteria. If you do not currently have TPS, you may apply from May 19, 2011 through Nov. 15, 2011. Please see information below for additional registration instructions.

Individuals with pending TPS applications
If you applied for TPS under the initial designation announcement in January 2010 and your application is still pending as of May 19, 2011 you will not need to file a new Application for Temporary Protected Status (Form I-821). Your pending application will be considered an initial filing under this re-registration. However, if you need to extend or request an Employment Authorization Document (EAD) you may need to file a new Application for Employment Authorization (Form I-765) starting May 23, 2011. Please see information below for additional information about filing for employment authorization.

Individuals re-registering for TPS
If you have already been granted TPS for Haiti, you must re-register once the Federal Register Notice with re-registration instructions is published in May 2011. The re-registration period will be May 23, 2011 to Aug. 22, 2011. By filing for re-registration as soon as this time period opens, you will enhance USCIS’s ability to complete all routine background checks, application processing and delivery of EADs promptly. Applications for TPS re-registration will not be accepted before May 23, 2011.

NOTE: Because the effective date of the re-designation is July 23, 2011, USCIS cannot approve any initial TPS applications under the re-designation until July 23, 2011. However, USCIS will issue temporary EADs to prima facie (see definition below) initial applicants, if an EAD is requested, prior to the July 23, 2011 effective date of the re-designation.  An applicant will be considered eligible if there is no disqualifying evidence on the face of the application or in the applicant’s background checks.

To be prima facie eligible, it must appear to USCIS that you are eligible for TPS on the face of your application and that there is no known, potentially disqualifying information resulting from your background checks. See 8 C.F.R. § 244.1 for more regarding the definition of prima facie eligibility.

To register or re-register you must file both forms together, even if you do not want work authorization.

NOTE: If you filed a TPS application for the original designation and it is still pending as of May 19, 2011, and you need to request a new EAD, you must submit the Form I-765 application fee with the Form I-765.

You must also pay the separate biometrics fee if you are age 14 or over.

Filing for Employment Authorization

It is important that you do not check the following boxes on your Form I-765 next to “I am applying for” if you do not want to request or extend an EAD:

  • Permission to accept employment
  • Replacement
  • Renewal of my permission to accept employment

Filing an Application for Temporary Protected Status

When completing your Form I-821 you must answer all questions listed in Part 4, Eligibility Standards, Question 2, on Form I-821.  If you answer “yes” to any of these questions, you must explain on a separate document and/or submit supporting documents with your application.
