Objections

In some cases the prosecutor handling your expungement may object to certain records being expunged or to all of your records being expunged. If this occurs Mr. Gomez will seek a hearing before the Superior Court to determine whether the prosecutor has any right to object to your expungement.

Mr. Gomez may prepare a legal brief to support a legal argument justifying your expungement. Cases involving an expungement hearing in Superior Court may result in winning your expungement case over the prosecutor's objections. However, if that is not successful, you may still appeal to higher appellate courts for a final decision.

It is important to note that expungement cases that are complicated by a hearing will always be more expensive than a regular expungement.
