Using a DWI Expert's Report to challenge the Alcotest readings is permitted in New Jerey Courts. The typical use of the DWI Expert's report is to show the court that the reading used against the defendant is erroneous and should be lowered to under .10% BAC. Once the prosecutor and the court agree that the expert's report creates a reasonable doubt as to the .10% reading, the defendant now faces a 3 month license suspension instead of a 7 month license suspension.
Using a DWI expert in your case is generally an important way to defend your case. Althought the use of the expert's report may require an extra cost because you must pay for the expert, this strategy is generally the safest way to approach a DWI case where the reading being used is very close to the .10% threshold.
Rafael Gomez has employed DWI Experts in many DWI cases with great success. Mr. Gomez generally recommends to his clients the use of a DWI Expert because it is one of the best ways to protect his clients rights.
